1. Acceptance of Terms

By accessing or using Fintora (“Fintora”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

2. Description of Service

Fintora is a software-as-a-service (SaaS) analytics platform designed to help users monitor, analyze, and visualize trading account performance.

  • Trading analytics and performance reporting
  • Equity, balance, and drawdown monitoring
  • Trade history tracking and visualization
  • Expert Advisor (EA) management and preset version control
  • Remote EA monitoring and configuration (for compatible EAs)

Fintora does not execute trades, hold funds, or connect directly to brokers unless explicitly authorized by the user.

3. Beta & Development Status Disclaimer

IMPORTANT: Fintora may be offered in beta or pre-release form.

  • Features may change, break, or be removed without notice
  • Data accuracy, availability, or completeness is not guaranteed
  • Downtime, bugs, or unexpected behavior may occur
  • The Service is provided for testing and evaluation purposes

4. No Financial Advice

FINTORA DOES NOT PROVIDE FINANCIAL, INVESTMENT, OR TRADING ADVICE.

  • No signals, recommendations, or trade instructions are provided
  • All data is informational and analytical only
  • You are solely responsible for your trading decisions
  • Past performance does not guarantee future results

5. Prop Firm & Risk Rules Disclaimer

If you use Fintora in connection with proprietary trading firms, evaluation accounts, or risk-restricted programs:

  • Fintora does not guarantee compliance with prop firm rules
  • You are responsible for understanding and following firm requirements
  • Rule violations, account failures, or resets are your responsibility
  • Analytics delays or inaccuracies may occur

6. User Responsibilities

  • Provide accurate and current information
  • Maintain the confidentiality of your credentials
  • Use the Service in compliance with applicable laws
  • Not misuse, exploit, or attempt to compromise the platform
  • Not reverse engineer, scrape, or automate access without permission

7. Data Accuracy & Third-Party Sources

Fintora may rely on data from third-party brokers, platforms, or user-provided sources. We do not guarantee the accuracy, completeness, or timeliness of such data.

8. Service Availability

  • No guarantee of uninterrupted availability
  • Maintenance may occur with or without notice
  • Features may be modified or discontinued
  • Access may be suspended to protect security or integrity

9. Payments & Subscriptions

  • Fees are billed in advance where applicable
  • Payments are non-refundable except where required by law
  • You may cancel at any time; access continues until period end
  • Pricing changes apply to future billing cycles

10. Intellectual Property

All platform software, designs, branding, and content are owned by Fintora or its licensors.

Your trading data remains yours. You may export it at any time.

11. Privacy, GDPR & CCPA

We process personal data in accordance with our Privacy Policy.

  • EU users have rights under GDPR
  • California residents have rights under CCPA
  • You may request access, correction, or deletion of data

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Fintora is provided “AS IS” and “AS AVAILABLE”
  • No liability for trading losses or missed opportunities
  • No liability for data inaccuracies or delays
  • Total liability limited to fees paid in the last 12 months

13. Termination

We may suspend or terminate access for violations, abuse, or to protect platform security.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
